Tom Homan, a former acting director of ICE, has responded to Rep. Alexandria Ocasio-Cortez following her recent town hall where she discussed migrants' rights regarding deportation. Homan stated that her advice is detrimental and could lead to legal trouble for those receiving it.

Speaking publicly, Homan asserted that Ocasio-Cortez's guidance, intended to help migrants avoid removal, instead teaches them behaviors that can result in prosecution. He argued that deliberately hindering removal orders issued by federal judges is a violation of law.

Ocasio-Cortez recently held a "Know Your Rights" session in her district, advising migrants on interacting with authorities seeking to deport them. She reportedly encouraged asking for warrants and recording interactions.

The congresswoman publicly challenged Homan, saying she was not afraid of his previous suggestion to refer her actions to the Justice Department. She stated her advice was legal and based on constitutional protections.

Homan countered that failure to comply with ICE actions or hindering one's own removal after receiving a final order violates Title 8, United States Code 1253. He indicated that enforcement concerning these violations would commence.

He announced plans for upcoming criminal prosecution for those found hindering the deportation of individuals with final orders. Homan stated there would be increased efforts to locate and apprehend these individuals, particularly in sanctuary cities such as New York.

The increased focus on enforcement follows a period under the Trump administration marked by mass deportations and immigration enforcement actions.
